the Organizer Coach (TOC) Residential House Cleaning Service Agreement
A house cleaning Service Agreement is an agreement between the Organizer Coach (TOC) Organizing and Cleaning, who will provide house cleaning services to a Client. This type of Service Agreement is beneficial because it provides the terms and conditions of the arrangement, allowing both parties to have clear reasonable expectations.
TOC Residential Cleaning services reserves the right to make any changes to any part of this Service Agreement without giving prior notice.
By scheduling TOC Residential Cleaning services by telephone, email, text message or private message, the Client accepts and agrees to TOC Service Agreement.
EMPLOYEES
TOC Residential Cleaning Service employees are carefully selected and professionally trained to provide the best client experience. To ensure that each employee knows and understands what is expected of them, a Cleaning Checklist is provided to each employee for the three (3) different levels of cleaning:
*Basic Clean/Regular Clean
*Deep Clean
*Move In/Out (Make Ready)
Clients have the option of creating a customized clean, in which the client is responsible for communicating when scheduling. For your protection and peace of mind, all employees undergo a nationwide background check, reference check, drug screen, are legal United States citizens, and covered under our Workers Comp and liability insurance policy.
Whenever possible, you will have the same professional house cleaner in your home for each subsequent visit. Open communication is the ultimate goal and therefore, we encourage employees to communicate with their Clients and Clients with staff to achieve a customized experience that best honors the Client.
PAYMENT
Payments are due in FULL date of service completion. For your convenience, an invoice will be emailed the same day services are rendered. Acceptable methods of payment include cash, check, credit/debit card. Clients paying with cash or check – leave payment at the home in an envelope marked CLEANING PAYMENT.
If an invoice remains unpaid for two (2) weeks, services will be suspended until payment has been paid in full.
CLUTTER
TOC Residential Cleaning Services strives to provide the most complete clean possible, however; there are times when clutter in the home may interfere with the effectiveness of our team. While TOC is an Organizing business, our Professional Organizers are separate from our Professional House Cleaners.
Picking up toys, laundry, clothes, magazines, papers, and otherwise working around clutter will reduce the efficiency of our team and we cannot guarantee a complete clean. It is strongly recommended that the Client pick up items off the floor, put away papers, toys, etc. prior to the arrival of our team to ensure the best possible service.
If Client requests Laundry Services, this is an ADD-ON SERVICE and must be communicated when scheduling cleaning services.
TIPPING
TOC doesn’t require tipping, however; leaves the decision to the discretion of the Client. Should the Client want to tip, please leave the tip in a clearly marked envelope in your home.
REFUNDS
Since cleaning is a personalized, customized and subjective service, NO REFUNDS are offered. TOC Residential Cleaning Services wants you to be 100% satisfied with our services and will work together with you to create a suitable solution that will be negotiated between the Client and Owner of TOC Residential Cleaning Services, not the employee.
PRICE ADJUSTMENTS
TOC Residential Cleaning Services reserves the right to issue rate increases at any time. Clients will be notified by email and/or in person, when possible. As needs and conditions within a home change, increases or decreases may be necessary. Prices for regular maintenance cleaning are guaranteed not to change for the first twelve (12) months. If a Client discontinues service then reinstates service with TOC Residential Cleaning Services after a period of three (3) months, the original price is not guaranteed (not “grandfathered”) and a new rate may be applied.
PARKING
If free parking isn’t available within one (1) block radius of the Client’s home, the Client is responsible for providing our staff with any one of the following:
*Permitted parking space (personal or public)
*Valid parking permit or
*Payment to cover all parking fees incurred while servicing the home
If parking can’t be found within a one (1) block radius by the cleaning team or provided by the Client within fifteen (15) minutes after the employee arrives, the appointment will be rescheduled or cancelled. In such an event, a fifty-dollar ($50) cancellation fee will be charged to the Client.
KEYS AND ALARM SYSTEMS
TOC Cleaning Services provides secure and safe measures for our Client’s residential keys. Keys aren’t mailed, they will be hand-delivered in person when returned to the Client. We prefer that security alarms be left off on cleaning days and will communicate with the Client when services are complete in order for Client to reset security alarm. If the Client decides to leave the security alarm on, the Client is responsible for providing the access code to turn off the alarm.
LOCK OUTS
Fifty Dollars ($50) will be assessed in the event that our team arrives and is unable to access the premises for any reason.
ARRIVAL
TOC Cleaning Service team is punctual. Client is expected to be present or have made previous arrangements so that the cleaning team has access to the home at the scheduled time. Failure to do so may result in re-scheduling or canceling the service in which a fifty-dollar ($50) cancellation fee will be charged to the Client.
CANCELLATIONS AND RESCHEDULING
Twenty-four (24) hour cancellation or rescheduling notice is required of any appointment. Fifty Dollars ($50) cancellation fee will be charged to the Client.
TARDINESS
The Client will be notified as soon as possible and provided with a new expected time of arrival if the cleaning team is running late due to cancellations, lockouts, etc.
PETS
TOC Cleaning Services is pet friendly, however; in order to be as efficient as possible and provide Client with best possible cleaning experience, please ensure pets are secured and safe on cleaning days. The Client will advise TOC Cleaning Services of any special requirements for safeguarding pets and if pets are dangerous for the cleaning team, pets are required to be secured for the safekeeping of our employees. It is Client’s responsibility to clean up after pet accidents.
TOC Cleaning Services will leave certain areas and/or items untouched:
*Pet homes/bed/toys
*Litter boxes
*Fecal, urine, blood or vomit
VALUABLES
Heirlooms, collectibles, unusually expensive objects or irreplaceable items are to be secured and put away to avoid any potential accidents. The Client will inform TOC Cleaning Services of any valuables not to be cleaned or handled. Please secure money, credit cards and checkbooks as well. While our staff is top notch, we don’t want to be placed in a position of suspicion if anything is missing. TOC Cleaning Services is not responsible for missing currency.
BROKEN OR DAMAGED ITEMS
TOC Cleaning Services team members are diligently trained to care for Client’s belongings. However, regrettably and although uncommon, there are times when items may be accidentally broken or damaged. If Client believes a TOC Cleaning Service team member damaged an item in home, it must be reported to the Owner within twenty-four (24) hours from the completion of service in order to allow TOC Cleaning Services to properly investigate the situation. If TOC Cleaning Service damages anything during the cleaning service, the Client will be notified immediately. In the event of damage, TOC Cleaning Service reserves the option to repair or replace the item instead of paying for the value of the damaged item. TOC cleaning Services is not responsible for items that were broken or damaged prior to arrival of the cleaning team. We are not responsible for improperly functioning furniture, items that were improperly attached or secured to the wall (ex: a hanging picture that was improperly attached to the wall or an item that is propped against a surface).
GLASS SHOWER DOORS
The Client is responsible for notifying TOC Cleaning Services if a glass shower door isn’t 100% secured. The TOC Cleaning team will inspect all glass shower doors to ensure they are fully secure prior to cleaning. If, upon inspection, the team recognizes that the door(s) aren’t fully secure, the Client will be notified of the risks and will be given the option to decline shower cleaning service. Should the Client opt to proceed with service in spite of the risks, the Client agrees not to hold TOC Cleaning Services or its employees responsible if this results in the shower door being damaged/broken. TOC Cleaning Services is not responsible for damage due to faulty and/or improper installation of any item.
EXTRA SERVICES
If the Client requires extra services or additional cleaning added to Client scheduled cleaning day, please contact TOC Cleaning Service forty-eight (48) hours in advance so that we may adequately allow the extra time needed to complete the requested tasks and provide estimated additional costs.
LIFTING, CLIMBING AND BENDING
TOC Cleaning Service employees do not climb higher than a three (3) foot step ladder, move or lift items heavier than twenty pounds (20 lbs.) or clean floors on their hands and knees, with the possible exception of bathroom floors.
Our employees are very important to us and these types of activities put our cleaning team at risk for back injuries and/or possible damages in the Client’s home. Cleaning will be done underneath heavy furniture, items, etc. (when accessible). The cleaning team will not move:
*Furniture containing electronics
*Appliances (refrigerator, stove, washer/dryer, etc.)
IF heavy items have been moved in advance of the cleaning team’s arrival, the cleaning team will clean items. It is the responsibility of the Client to return heavy items (furniture, appliances, etc.) to the original setting.
IN-HOME CLIMATE CONTROL
In-home temperatures should be comfortable prior to the start of service. Under no circumstances will cleaning services be performed in an environment that isn’t physically comfortable for labor. This includes, but is not limited to, extreme heat or cold. In the event that the cleaning appointment is cancelled due to uncomfortable conditions within the home, a fifty-dollar ($50) cancellation fee will be charged to the Client.
EXCLUSIONS
In addition to the exclusions already addressed herein, TOC Cleaning Services staff DOES NOT perform the following services:
*Clean or remove blood or bodily fluids
*Clean or remove fire, water damage or mold (We are not properly trained or equipped to safely clean these situations – can refer resources)
*Clean or remove insect infestation (including seasonal). In the event an infestation is identified, the cleaning team will leave the property and the Client will be contacted immediately. A fifty-dollar ($50) cancellation fee will be charged to the Client
*Clean curio cabinets or hutch interiors
*Clean or shampoo carpet
*Clean chandeliers
*Clean window exteriors
*Clean animal waste or litter
*Clean human waste
*Clean areas above three-foot (3 ft.) ladder reach
*Provide stain removal
*Remove paint
*Service outdoor areas
*Move or lift items exceeding twenty pounds (20 lbs.)
MISCELLANEOUS
The provisions in the Service Agreement may only be waived with the prior written consent of TOC Cleaning Services and the Client, and no course of conduct or failure or delay in enforcing the provisions of this agreement shall be construed as a waiver of such provisions or affect the validity, binding effect, or enforceability of this Severance Agreement or any provision herein.
If any provision of this Service Agreement is held to be illegal, invalid, or unenforceable under any present or future laws or public policy, such provision shall be fully severable and shall in no way affect the validity or enforceability of this agreement or any other provision herein.
This Service Agreement is made and shall be enforced pursuant to the laws of the State of Texas. It is the intent of the parties that this agreement may be disclosed to a court of law and that the terms of this Service Agreement are binding upon the parties in a court of law. All actions brought to enforce this agreement shall be brought in federal or state courts located in Grapevine, Texas.
In the event that TOC Cleaning Services is required to file a lawsuit to enforce this agreement, it will be entitled to recover all attorneys’ fees and costs from the Client.
PRIVACY AND CONFIDENTIALITY
Client information is secure, safe and will never be shared with any outside source. TOC Cleaning Service is serious about Client privacy and confidentiality.
